The terms governing your use of the NextWise Finserv website and our loan/insurance referral services, drafted in accordance with Indian law including the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019.

This Terms of Service document is drafted with reference to the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019 (and Consumer Protection (E-Commerce) Rules, 2020, to the extent applicable), and the Reserve Bank of India's guidelines applicable to Direct Selling Agents (DSAs). It is intended as a comprehensive, good-faith template and should be reviewed by a qualified Indian lawyer before publication — particularly the limitation-of-liability, arbitration, and DSA-disclosure clauses, which carry real legal weight.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and NextWise Finserv ("NextWise Finserv", "we", "us", "our") governing your access to and use of our website located at nextwisefinserv.in (the "Website") and any related services (collectively, the "Services"). By accessing the Website, submitting an enquiry form, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website or our Services.

2. Nature of Our Services

NextWise Finserv operates as a Direct Selling Agent (DSA) / loan and insurance referral intermediary. We connect prospective borrowers/policy-seekers with partner banks, non-banking financial companies (NBFCs), and insurance companies (collectively, "Lending/Insurance Partners").

Important: NextWise Finserv is not a bank, NBFC, or insurer. We do not sanction, underwrite, disburse, or service any loan or insurance policy ourselves. All lending and underwriting decisions, sanction letters, disbursals, interest rates, premiums, and policy terms are determined solely by the relevant Lending/Insurance Partner, at their sole discretion, in accordance with their own credit and underwriting policies.

3. Eligibility

To use our Services, you must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. By submitting an application, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

4. User Obligations

When using our Website or Services, you agree to:

  • Provide true, accurate, and complete information in all application forms, including your name, contact details, business information, and annual turnover;
  • Promptly update us if any information you have provided changes or becomes inaccurate;
  • Not impersonate any other person or entity, or misrepresent your affiliation with any person or entity;
  • Cooperate with our advisors and our Lending/Insurance Partners during the application, verification, and documentation process; and
  • Independently review and satisfy yourself of all terms, interest rates, fees, and conditions offered by any Lending/Insurance Partner before accepting any loan or policy.

5. No Guarantee of Approval

Submitting an enquiry or application through our Website does not guarantee that any loan or insurance product will be approved, sanctioned, or disbursed to you. Approval, the amount sanctioned, interest rate, tenure, and all other terms remain entirely at the discretion of the relevant Lending/Insurance Partner, based on their internal credit policy, your creditworthiness, and applicable regulatory requirements. Any indicative rates, tenures, or amounts shown on our Website (including in our EMI calculator) are illustrative only and do not constitute an offer or commitment by us or any Lending/Insurance Partner.

6. Fees & Charges

NextWise Finserv does not, as a general practice, charge borrowers/applicants a fee for using our referral Services to connect them with Lending/Insurance Partners; our services are typically compensated through referral/commission arrangements with our Lending/Insurance Partners. Any processing fees, documentation charges, insurance premiums, or other charges levied in connection with your loan or policy are determined and collected solely by the relevant Lending/Insurance Partner, and you should confirm all such charges directly with them before proceeding. Should NextWise Finserv ever charge you directly for a specific advisory service, this will be clearly communicated and agreed with you in writing beforehand.

7. Third-Party Lender Terms

Once your application is forwarded to a Lending/Insurance Partner, your relationship with respect to the loan or policy (including its terms, disbursal, repayment, servicing, foreclosure, claims, and grievance handling) is governed directly by the agreement you enter into with that Lending/Insurance Partner and their own terms and conditions, privacy policy, and grievance-redressal mechanism — which you should read carefully. NextWise Finserv is not a party to, and assumes no liability arising from, the contract between you and any Lending/Insurance Partner.

8. Intellectual Property

All content on this Website, including text, graphics, logos, the "NextWise Finserv" name and mark, and the layout and design of the Website, is the property of NextWise Finserv or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works from any part of this Website without our prior written consent.

9. Prohibited Conduct

You agree not to:

  • Submit false, fraudulent, or misleading information in any application;
  • Use the Website for any unlawful purpose or in violation of any applicable Indian law, including the Information Technology Act, 2000;
  • Attempt to gain unauthorised access to our systems, servers, or any data not intended for you;
  • Introduce viruses, malware, or other harmful code through the Website; or
  • Scrape, harvest, or misuse any content or data from the Website for commercial purposes without our consent.

10. Disclaimer of Warranties

The Website and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted under applicable law, NextWise Finserv disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable Indian law, NextWise Finserv, its directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website or Services, including any loss arising from the rejection of a loan/insurance application, the terms offered by a Lending/Insurance Partner, or any act or omission of a Lending/Insurance Partner. Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable Indian law, including in cases of fraud or wilful misconduct.

12. Indemnification

You agree to indemnify and hold harmless NextWise Finserv, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Website, or the inaccuracy of any information you have provided to us.

13. Privacy

Your use of the Website and Services is also governed by our Privacy Policy, which describes how we collect, use, and share your personal data in accordance with the Digital Personal Data Protection Act, 2023 and applicable rules. By using our Services, you consent to the data practices described therein.

14. Grievance Redressal & Dispute Resolution

In accordance with the Information Technology Act, 2000 and the Consumer Protection Act, 2019, we have appointed a Grievance Officer to address any complaints regarding our Services:

We will acknowledge and endeavour to resolve any grievance within a reasonable time. Should a dispute not be resolved through this process, the parties may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Ahmedabad, Gujarat, with proceedings conducted in English. This does not affect your statutory right, as a consumer, to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 14 above, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

16. Amendments

We may revise these Terms from time to time to reflect changes in our Services, business practices, or applicable law. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Website after any such changes constitutes your acceptance of the revised Terms.
